Contracting Out for Small Businesses
Ofcom’s General Conditions of Entitlement (“GC”) have special provisions for small businesses (10 employees or fewer) when they purchase telecoms. We offer extremely competitive commercial terms to small businesses, but we can only do so a streamlined basis. This means we need your consent to contract out of some of the GC provisions, as set out below:
| GC clause | Being disapplied | Replaced with |
| C1.3–C1.7 | Pre-contract information; Contract Summary, setting out details of customer rights, remedies, key contract terms; price change information | Order Form and Standard Terms clearly set out full commercial terms, including full price transparency, in our streamlined format, not the prescribed Ofcom format |
| C1.8 | Procedures for end of contract termination not to act as disincentives to change providers | Termination terms in our Standard Terms, including any notice periods and early termination charges |
| C1.11 | Maximum contract durations 24 months | Commitment Period in the Order Form, which may exceed 24 months |
| C1.12 | Purchase of additional services not to extended contract duration | If you purchase further services, the Commitment Period for these go beyond the period above |
| C1.14–C1.20; C1.21–C1.36 | Terms regarding bundled packages, extending the above requirements to each element of a bundle | Those provisions do not apply to the bundle as a bundle; protections for each individual service continue |

I have read and understood the above terms on Contracting Out for Small Businesses. I have considered the effect of these terms being disapplied in respect of my business. I am happy and agree that the provisions shall not apply to this contract.
